Press Release: Labour Office Recommendation Win SENFU Workers Demands

Mediation between employer of PT. Senopati Fujitrans Logistic Services (PT SENFU) with workers has over by releasing an written recommendation from labour office, Dinas Tenaga Kerja (Disnaker) of Bekasi district number 565/4669/Disnaker dated 4 September 2019, which states as below:

  1. In order to employment relations between Abdul Rahman, et al (45 people) with PT. Graha Indotama Taramadina changes to employment relations between the workers with PT. Senopati Fujitrans Logistic Services;
  2. In order to employment relations between Abdul Rahman, et al (45 people) with PT. Senopati Fujitrans Logistic Services are based on Work Agreement for an Unspecified Period of Time (Perjanjian Kerja Waktu Tidak Tertentu / PKWTT) starting from the employment relations.
  3. In order to the employer of PT. Senopati Fujitrans Logistic Services pay the workers’ rights as usual as long as the workers are not employed.

Confirmed, attorney of the workers, Damiri states his side accept the Disnaker’s Advices, but it does not rule out a possibility to sue (the employer) at the Industrial Relations Court of Bandung if they refuse implementing the Advice.

“We are welcome if the employer is willing to implement the Advice rather than the case is more protracted. If more protracted, more bigger potential wages that should be paid by the employer,” said Damiri.

As also a paralegal of Perhimpunan Bantuan Hukum dan Hak Asasi Manusia (PBHI/the Association of Legal Aid and Human Rights Defender), his side has calculated the potential wages to be paid by the employer amounting IDR 3 billion for 45 workers.

The workers have sent letters of willingness for working back, but the employer refused the letters by sending it back to the workers.

“We will offer a negotiation once again as a good faith. If the employer refuses it or no agreement, so we will continue the dispute by taking it to litigation and non-litigation process,” Damiri said clearly.

PT. SENFU hired 45 workers in spare part warehouse of Mitsubishi. The workers have reported the case to PT Krama Yudha Tiga Berlian Motors (KTB) as representative of Mitsubishi in Indonesia, noticing social responsibility of Mitsubishi on Mitsubishi’s code of conduct. Until today, the workers are still waiting for effort of enforcement of Mitsubishi’s code of conduct from PT KTB.
